In the name of God Amen this fowerteenthe Day of November and in the yeare of our Lord one thousand six hundred twenty and two,
I Custance Sotherone [sic] of Holme in Spaldingmore within the Countie of Yorke, widdowe, sicke in bodie but of good and perfecte remembrance, praised be Allmightie god, doe make and ordeyne this my last will and testamente, recallinge all former wills, in manner and forme followeinge.
First I give and bequeath my Soule to allmightie god my maker and to Jesus Christ in whom alone I putt my whole confidence, my redeemer, and my body to be buryed in the parish church or churchyeard of Holme afforesaid. Itm I give and bequeath to Mathewe Sotherone one farme in the waterend wherein John landsley now dwelleth, to him and his heires for ever. Itm I give and be queath unto Anne Dayles my daughter one house w*b apprtennes knowne by the name of Woodhouse, w*b the wood close, and one other little close theirto adioyne inge, duringe her naturall life, payinge unto Jaine Sotheran and Isabell Sotheran, daughters of John Sotheran, the value of xl s. yearely. Provided allwaies that she shall not cutt downe any of the greater timber. And after the death of Anne to come to Mathewe Sotheran and his heirs forever.
Itm I give and bequeath unto Robert Apleton, sonne of Symon Apleton of Newbald, one house wth the apprtennes in the waterend now in the occupacon of Robert Plaxten als Plasteer, payinge unto Mary Appleton his said sister the sume of forty pownds.
Itm. I give and bequeath unto Phillipp Sotheran and her heirs for ever, my yongest daughter, one house in the moore end wth the apprtennes theirto belongeing now in the tenure and occupacon of Alice Barley.
Itm I give unto Anthony Crosbie, sonne of Thomas Crosbie, the sume of ten pounds. Itm. I give unto Thomas Crosbie, sonne of the said Thomas Crosbie, ten pownds wth all my ploughgeare cowpes, waines, and all other implemts unto the said things belongeinge as yocke and teames and such like things. Itm I give unto William Crosbie, sonne of the said Thomas Crosbie, the sume of five pownds. Itm I give unto Symon Crosbie, the yongest sonne of the said Thomas, thirteene pownds six shillings eight peence.
Itm. I give unto Mary Appleton, daughter of Symon Apleton of Newbald, the sume of teun pownds. I give and bequeath unto John Dayles, sonne of John Dayles, the sume of six pownds thirteene shillings eight pence, and fortie shillings to be paid yearly out of my knds att Holden duringe his life naturall, and one Cowe. Itm I give and be queath unto Phillip Dayles, daughter of the said John Dayles, six pownds thirteene shillings and eight pence, and forty shillings to be paid yearely to her out of my lands at Holden duringe her life naturall, wtb one Cowe. Itm I give and bequeath unto William Dayles, the yongest sonne of the said John Dayles, six pownds thirteene shillings eight pence, and one Cowe.
Itm I give to the poore of Holme afforesaid xl s. to be distributed att my buryall. Itm I give and bequeath unto the said William Dayles, sonne of the said John Dayles, the whole and entire sume of xl s. to be paid yearely to him dureinge his naturall life out of my lands of Holden by my sonne John Sotheran, and the remainder theirof to redound to himselfe. Itm I give and bequeath unto Phillip Sotheran the rest of my goods ungiven and unbequeathed, and if the goods do not amounte to the full satisfieing of these my legac[ie]s allreadie given, my will is that the said Phillip Sotheran shall make them upp and pay them out of the rente of Barley wife's house wherein nowe she dwelleth.
And I doe make the said Phillipp Sotheran my full and perfecte executrix of this my last will and testamente. In witnes whereof I have setto my hand and seale this day and yeare abovesaid. Sealled in the prsence of us viz: John Laycocke, Anthony Lambert, Anthony Crosbie.
Will proved 20 May 1623 by the executrix Phillipa Sotheran.".
